Family Immigration

An individual can seek immigrant status provided they have a relative that is a US Citizen or lawful permanent resident (green card holder). Not all family members are immediately eligible; however spouses and children are given special preference.

There is no limit to the number of visas that can be applied for in this category. The visa is issued immediately after the paperwork is processed by the USCIS.

Preferences are given to the following family members:

1.     Their unmarried child over 21 years of age and their children. (First preference)

2.     Married children of the US citizen and their children. (Third preference)

3.     Siblings of the US Citizen and their spouses and children. (Fourth preference)

There is a limit to the number of visas issued in the category each year, and there could be long waiting periods depending upon preference category and country of origin. Generally speaking, those from Mexico, China, Philippines, and India have the longest wait.
